Description: The Civil War Collection consists of material acquired over many years from different sources. Coverage is of Lancaster County soldiers and of daily life in the county during the Civil War. The collection contains records of various military units, family correspondence, "Home Front" papers, Civil War era diaries, the Captain John R. Bricker/Dept. of Commissary papers, celebration and reunion materials, images, newspaper clippings, and general orders.

Title: Habeas Corpus Papers

Description: A writ of habeas corpus is a procedure for obtaining a judicial determination of the legality of an individual's custody. This collection includes petitions for writs of habeas corpus and the writs themselves, showing the names of petitioners, persons to be brought to court, nature of dispute or alleged crime, dates of writs and accompanying documents, names of judges, and names of persons that the writs are filed against. Petitioners include indentured servants, Freedom Seekers, free African-Americans, convicted prisoners, those awaiting trial, relatives of prisoners, parties in child custody disputes, and relatives of army recruits and draftees. Handwritten, handwritten on printed forms, and a very few typewritten.

This portion of the article discusses disappointment that the Stevens bill for enlisting [men of color] did not become law, men of color serving in the U.S. Army, the draft and use of substitutes, political views on the war and people of color migrating to Pennsylvania, and General Burnside. Incomplete article from The Columbia Spy. 1863.

Admin/Biographical History: Thomas Welsh (1824-1863) was a Lancaster County native (born and raised in Columbia), who rose from hardscrabble origins to local fame, first as a Mexican War hero, and then as a brigadier general during the Civil War. He was well known and well respected as a no nonsense officer, for his leadership and gallantry in battle, for his dedication to the service of his country, and for his concern for the welfare of his men. See MG0828 for more biographical information.

Title: Civil War Enlistment Certificates

Description: This collection contains certificates of enlistment for volunteer soldiers from Lancaster City for April and May 1864. The documents show the name of the volunteer; the ward he was from; date; and signatures of volunteer, witness, and/or the draftee for which the volunteer was a substitute; and signatures of members of the Committee on Bounty Fund. These volunteers were "credited to the quota of the City of Lancaster, in the President's calls for troops."

Admin/Biographical History: "No conscription in the North during the Civil War was absolute. The drafted man could always hire a substitute if he could afford it. Starting in 1862, the U.S. government allowed this escape from military service on the theory that, so long as each name drawn from the wheel produced a man, it made no difference whether the drafted person or one hired to take his place appeared for muster. The Conscription Act of 3 March 1863 legalized this method of draft evasion. Until the act of 24 February 1864, the conscript could choose between hiring a substitute or paying the government $300 as commutation of service. Thereafter, the government only permitted substitution, except for conscientious objectors. Furthermore, exemption by furnishing a substitute extended only until the next succeeding draft, at which point the principal again became liable. Immediately, the prices of substitutes rose far above the $300 to which the commutation clause had held them. Title: Final draft of Thomas Welsh's South Mountain Battle Report

Description: Handwritten report in a copyist's hand of Welsh's South Mountain Battle Battle Report. Report details the activities of Welsh's 2nd Brigade (Willcox's 1st Division) during the battle of South Mountain. Command consists of Regiments 45th and 100th Pennsylvania, 46th New York, and 8th Michigan. Notes that 45th Pennsylvania "used the bayonet with success" and that the 45th Pennsylvania and 17th Michigan "sustained the brunt of the battle." Note: Except for a few words here and there, this does not appear to be Thomas Welsh’s handwriting; it was probably dictated.

Admin/Biographical History: Thomas Welsh (1824-1863) was a Lancaster County native (born and raised in Columbia), who rose from hardscrabble origins to local fame, first as a Mexican War hero, and then as a brigadier general during the Civil War. He was well known and well respected as a no nonsense officer, for his leadership and gallantry in battle, for his dedication to the service of his country, and for his concern for the welfare of his men.
