Buchanan, Trustees, acknowledging receipt of a check for $951 after commission and asking Swarr to correct overcharges of commissions himself rather than burden others with finding mistakes such as occurred when commissions amounting to $39 were twice charged, which could not be explained to Mr. Lightner. Swarr describing the restrictions on investment by law of the court; explaining that the court will only approve trust investments in securities that are explicitly enumerated by the legatee; noting that cash is not always in the hands of the executors; assuring him that the executors strive to give the maximum amount possible in the earliest time possible to the heirs of the ex-President; and hoping that they were not prevented from visiting Lancaster on the 5th by the condition of Harriet Lane Johnston’s health. Letter to Henry E. Johnston from H. B. Swarr requesting the delivery of Mrs. Johnston’s estate papers to Wheatland as soon as convenient; stating that in his letter of March 24th he had defended Edward Young Buchanan as co-executor using words copied from one of James Buchanan’s truest friends, a gentleman known to and respected by Mr. and Mrs. Johnston; explaining that his request for Mrs. Johnston to suggest a biographer for James Buchanan was meant to “hasten its accomplishment;” and stating his wish to perform his duty to the estate and legatees of the deceased while maintaining “ kindly relations with all.” Handwritten by unknown and signed by H. The James Buchanan Family Papers were collected by the James Buchanan Foundation for the Preservation of Wheatland. This collection was relocated from the Wheatland mansion to the LancasterHistory archives in the Spring of 2009. Booklet from the Court of Common Pleas presenting the defendants’ case (Henry E. Johnston and Harriet Lane Johnston) rebuttal to the plaintiff’s’ charges of October accusing Edward Young Buchanan of rummaging through the papers, removing some, destroying some, and leaving the rest in “utter confusion”; the business papers were deposited in a New York bank and the executors had access to the papers and the defendants contend that those given to Mr. Reed were returned to Edward Young Buchanan with some left at Wheatland, later taken away by Edward Young Buchanan; accused Edward Young Buchanan proceeded to “overhaul, destroy, distribute and appropriate all patters, documents and letters of this class,” offering her none of them; Edward Young Buchanan did not destroy those letters as requested by James Buchanan; they are willing to have the remaining letters at Wheatland distributed fairly to family members; offers to give the executors full access to any relevant documents still at Wheatland; an impartial biography of James Buchanan is very desirable and offer an additional $5000 of their share of the state to accomplish the feat. Swarr, executors of the estate of James Buchanan; after quoting the terms of the last will and testament of James Buchanan, the audit lists the expenses and distributing the remaining amount as follows: Harriet Lane Johnston $4643.76, John N. Lane $202.26, James B. Lane $202.26, Elliott E. Lane $202.26, John B. Weaver $151.69, EYB $782.45, James Buchanan Henry $613.57, Mary E. Dunham $306.77, James B. Weaver $76.69, Maria B. Weaver $76.69, and Jessie Magaw $76,69, Aggregate of contribution to biographical fund $1875.00, and aggregate if succession tax $108.39 for a grand total of $6314.69; and accounts for the bonds of the State of Tennessee; certified on 22 November 1873 by S. J. Kauffman, Deputy Clerk of Orphan’s Court.
