Swarr, executors of the estate of James Buchanan; after quoting the terms of the last will and testament of James Buchanan, the audit lists the expenses and distributing the remaining amount as follows: Harriet Lane Johnston $4643.76, John N. Lane $202.26, James B. Lane $202.26, Elliott E. Lane $202.26, John B. Weaver $151.69, EYB $782.45, James Buchanan Henry $613.57, Mary E. Dunham $306.77, James B. Weaver $76.69, Maria B. Weaver $76.69, and Jessie Magaw $76,69, Aggregate of contribution to biographical fund $1875.00, and aggregate if succession tax $108.39 for a grand total of $6314.69; and accounts for the bonds of the State of Tennessee; certified on 22 November 1873 by S. J. Kauffman, Deputy Clerk of Orphan’s Court.

Letter from James Buchanan to Harriet Lane Johnston expressing joy that she and her son are doing well; asking her to purchase a Christmas gift of jewelry for Becky Shunk; commenting on the coming holidays when Harriet Buchanan’s “lover” will be home from his divinity studies, but that she might find a more suitable match in Baltimore unless she is engaged; really upset at the snubbing of Mrs. Lane and even his interest in her children has “vanished in a great degree”; and saying he had an agreeable visit to brother Edward’s family, Lois has regained her health, and he was not dissatisfied with the abandonment of Henrietta by Cecil. Printed version of the court case between the executors of James Buchanan’s estate and Henry E. Johnston and Harriet L. Johnston, his wife, concerning the papers left by Buchanan, some delivered to William B. Reed for the purpose of writing a biography (as directed by the will, but Reed refused to write the biography), the alleged mis-handling by E. Y. Buchanan of a large number of family papers in the possession of the defendants, and the unwillingness of E. Y. Buchanan to destroy certain papers as directed by the will. Lancaster.

Printed version of the will of James Buchanan directing that his body be interred in the Woodward Hill Cemetery; that all debts (“which are small”) be paid out of the estate; that the furnishings of the house be divided among Harriet L. Johnston, Edward Y. Buchanan and J. Buchanan Henry, with the provision that Esther Parker be given $200 worth of the articles; bequeaths his wearing apparel, gold watch, watch chain and seals to Edward Y. Buchanan; bequeaths $5000 to Esther Parker; bequeaths his two certificates of loan, Nos. 43 and 43 or the sum of $2,000 if the certificates have been disposed of “for the use of poor and indigent females of the city” to be added to the $4,000 already provided; bequeaths $1,000 to the Presbyterian church in Lancaster of which he is a member; directs that all the real estate he owns be sold; directs that the proceeds from the sale of real estate, rents, etc., be distributed as described to his relatives: Harriet Lane Johnston, Edward Y. Buchanan, J. Buchanan Henry, John B. Lane, James B. Lane, Elliott E. Lane; Mary E. Dunham, Maria B. Weaver, Jessie Magaw, James B. Weaver, John Bliss Weaver and Maria Magaw. Codicils bequeath sums of money to Martha J. Lane, William B. Reed (to write his biography), his wife, Mary L. Reed; domestics Peter Hillyer, Mary Smithgall, Lizzie Stoner; and finally, bequeaths the dwelling at Wheatland and all its land of 22 acres to Harriet Lane Johnston. Lancaster. Letter to Harriet Lane Johnston from H. B. Swarr explaining that he will transmit to Edward Young Buchanan her concerns about the cemetery lots and the railing but without her accompanying remarks; noting that the mistake regarding the railings has been rectified so that the railings and posts are now placed entirely within the borders of the estate lots selected by James Buchanan for his place of interment, and will not include the additional lots jointly purchased; and regretting having to relate the details but wanting her to have all the facts. Letter to Henry E. Johnston from H. B. Swarr requesting the delivery of Mrs. Johnston’s estate papers to Wheatland as soon as convenient; stating that in his letter of March 24th he had defended Edward Young Buchanan as co-executor using words copied from one of James Buchanan’s truest friends, a gentleman known to and respected by Mr. and Mrs. Johnston; explaining that his request for Mrs. Johnston to suggest a biographer for James Buchanan was meant to “hasten its accomplishment;” and stating his wish to perform his duty to the estate and legatees of the deceased while maintaining “ kindly relations with all.” Handwritten by unknown and signed by H. B. Swarr. Lancaster.

Opinion of Judge Black regarding provisions of James Buchanan’s will: canes are not included in the category of wearing apparel; the sum of $12,000, the valuation of Wheatland in the will, is to be deducted from Harriet Lane Johnston’s one fourth of the general estate, any pecuniary value of James Buchanan’s papers must be divided among the legatees, but the executors may use their judgment in distributing papers of only sentimental value ; and a copy of only the canes and papers provisions in another hand. (1) Judge Black’s version, with Mrs. Johnston receiving $14,605.33 in cash,
(2) Mrs. Johnston’s version, with her receiving, in addition to the valuation of Wheatland, $18,605.33 in cash, and
(3) the version of the executors, E. Y. Buchanan and J. B. Henry, with, after the subtraction of $12,000 for the valuation of Wheatland, Mrs. Johnston receiving $6,605.33 in cash. Lancaster.
