Swarr, executors of the estate of James Buchanan; after quoting the terms of the last will and testament of James Buchanan, the audit lists the expenses and distributing the remaining amount as follows: Harriet Lane Johnston $4643.76, John N. Lane $202.26, James B. Lane $202.26, Elliott E. Lane $202.26, John B. Weaver $151.69, EYB $782.45, James Buchanan Henry $613.57, Mary E. Dunham $306.77, James B. Weaver $76.69, Maria B. Weaver $76.69, and Jessie Magaw $76,69, Aggregate of contribution to biographical fund $1875.00, and aggregate if succession tax $108.39 for a grand total of $6314.69; and accounts for the bonds of the State of Tennessee; certified on 22 November 1873 by S. J. Kauffman, Deputy Clerk of Orphan’s Court.

Printed version of the court case between the executors of James Buchanan’s estate and Henry E. Johnston and Harriet L. Johnston, his wife, concerning the papers left by Buchanan, some delivered to William B. Reed for the purpose of writing a biography (as directed by the will, but Reed refused to write the biography), the alleged mis-handling by E. Y. Buchanan of a large number of family papers in the possession of the defendants, and the unwillingness of E. Y. Buchanan to destroy certain papers as directed by the will. Lancaster.

Printed version of the will of James Buchanan directing that his body be interred in the Woodward Hill Cemetery; that all debts (“which are small”) be paid out of the estate; that the furnishings of the house be divided among Harriet L. Johnston, Edward Y. Buchanan and J. Buchanan Henry, with the provision that Esther Parker be given $200 worth of the articles; bequeaths his wearing apparel, gold watch, watch chain and seals to Edward Y. Buchanan; bequeaths $5000 to Esther Parker; bequeaths his two certificates of loan, Nos. 43 and 43 or the sum of $2,000 if the certificates have been disposed of “for the use of poor and indigent females of the city” to be added to the $4,000 already provided; bequeaths $1,000 to the Presbyterian church in Lancaster of which he is a member; directs that all the real estate he owns be sold; directs that the proceeds from the sale of real estate, rents, etc., be distributed as described to his relatives: Harriet Lane Johnston, Edward Y. Buchanan, J. Buchanan Henry, John B. Lane, James B. Lane, Elliott E. Lane; Mary E. Dunham, Maria B. Weaver, Jessie Magaw, James B. Weaver, John Bliss Weaver and Maria Magaw. Codicils bequeath sums of money to Martha J. Lane, William B. Reed (to write his biography), his wife, Mary L. Reed; domestics Peter Hillyer, Mary Smithgall, Lizzie Stoner; and finally, bequeaths the dwelling at Wheatland and all its land of 22 acres to Harriet Lane Johnston. Lancaster. Hiester that the defendants Henry Elliott Johnston and wife, Harriet Lane Johnston relinquish to the executors the papers of James Buchanan sent to Wheatland after William B. Booklet from the Court of Common Pleas presenting the defendants’ case (Henry E. Johnston and Harriet Lane Johnston) rebuttal to the plaintiff’s’ charges of October accusing Edward Young Buchanan of rummaging through the papers, removing some, destroying some, and leaving the rest in “utter confusion”; the business papers were deposited in a New York bank and the executors had access to the papers and the defendants contend that those given to Mr. Reed were returned to Edward Young Buchanan with some left at Wheatland, later taken away by Edward Young Buchanan; accused Edward Young Buchanan proceeded to “overhaul, destroy, distribute and appropriate all patters, documents and letters of this class,” offering her none of them; Edward Young Buchanan did not destroy those letters as requested by James Buchanan; they are willing to have the remaining letters at Wheatland distributed fairly to family members; offers to give the executors full access to any relevant documents still at Wheatland; an impartial biography of James Buchanan is very desirable and offer an additional $5000 of their share of the state to accomplish the feat.
