Printed version of the court case between the executors of James Buchanan’s estate and Henry E. Johnston and Harriet L. Johnston, his wife, concerning the papers left by Buchanan, some delivered to William B. Reed for the purpose of writing a biography (as directed by the will, but Reed refused to write the biography), the alleged mis-handling by E. Y. Buchanan of a large number of family papers in the possession of the defendants, and the unwillingness of E. Y. Buchanan to destroy certain papers as directed by the will. Lancaster.

Swarr explaining his objections to Mr. Howell’s proposal for the monument; noting that Mr. Diller’s estimate for the railing is higher than expected; noting that Mr. Pearce’s bill for John Weaver’s education must be paid soon, but more details are needed regarding Dr. Cardera’s bill for treating John; acquiescing to a remittance for Mrs. Dunham requested by Dr. Yates, but requiring written proof of her Uncle’s intention to forego charging her interest on her bond; asking for a copy of Judge Black’s opinion contained in Mr. Johnston’s letter; and cautioning against providing Mr. Johnston with their entire proceedings. Swarr regretting that the weather prevented him from coming to Lancaster to attend the funeral of Mr. Wharton; hoping that the matter of the mortgage has been straightened out with Mr. McMurtrie and the purchaser; returning receipts for money received on behalf of John Weaver and Mr. Johnston’s letter; replying at length to Mr. Johnston’s objections about the housing of James Buchanan’s papers; advising no reference to Judge Black’s alleged opinion on the value of the papers; advising no reply to Mr. Johnston’s request for suggestions for the author of James Buchanan’s biography, except in noting that Mr. Shunk is unacceptable; advising warning that funds might need to be withheld from the estate if Mr. Johnston keeps threatening legal action; raising the suggestion that presidential papers now at Wheatland be removed to Mr. Swarr’s home; and asking that his name not be mentioned in his reply to Mr. Johnston. Swarr thanking him for his resumé of his latest correspondence with the Johnstons; saying that Mrs. Johnston has no power to prevent the removal of the papers from Wheatland and leaving the legal steps necessary to remove the papers to Swarr; denying that he and his daughter Annie left papers at Wheatland in confusion after sorting out important ones for Mr. Reed, although agreeing that they are now in confusion; noting the absurdity of Mrs. Johnston suggesting that increasing the biographical fund to $20,000 would in any way assure the rapid acquisition of a suitable biographer; and sympathizing with Mr. Swarr on having to correspond with such unreasonable persons as the Johnstons.
