Booklet from the Court of Common Pleas presenting the defendants’ case (Henry E. Johnston and Harriet Lane Johnston) rebuttal to the plaintiff’s’ charges of October accusing Edward Young Buchanan of rummaging through the papers, removing some, destroying some, and leaving the rest in “utter confusion”; the business papers were deposited in a New York bank and the executors had access to the papers and the defendants contend that those given to Mr. Reed were returned to Edward Young Buchanan with some left at Wheatland, later taken away by Edward Young Buchanan; accused Edward Young Buchanan proceeded to “overhaul, destroy, distribute and appropriate all patters, documents and letters of this class,” offering her none of them; Edward Young Buchanan did not destroy those letters as requested by James Buchanan; they are willing to have the remaining letters at Wheatland distributed fairly to family members; offers to give the executors full access to any relevant documents still at Wheatland; an impartial biography of James Buchanan is very desirable and offer an additional $5000 of their share of the state to accomplish the feat. Printed version of the court case between the executors of James Buchanan’s estate and Henry E. Johnston and Harriet L. Johnston, his wife, concerning the papers left by Buchanan, some delivered to William B. Reed for the purpose of writing a biography (as directed by the will, but Reed refused to write the biography), the alleged mis-handling by E. Y. Buchanan of a large number of family papers in the possession of the defendants, and the unwillingness of E. Y. Buchanan to destroy certain papers as directed by the will. Lancaster.

Description
Letter from James Buchanan to Harriet Lane Johnston regretting that the weather and his age prevents him from visiting her; expressing shock at the death of Robert Magraw; expressing his joy that Judge Black and wife, Judge Fisher and wife, and Horatio King have visited on the judges’ way to Wilkes-Barre where the state supreme court will hear an important railroad case; expressing happiness the young ones” and Miss Hetty are friends; expressing joy that Thomas, after a “rampage” of eight days has returned but would be happier if he had only the services of Rosana, his wife; expressing disappointment that Mrs. Lane nor her sons have visited; expressing joy that Blanche Nevin has recovered from her illness; and saying he is very glad that he and James Henry have settled their affair, though he thinks that their friend Mr. Schell could have been more help to James in his business; and expressing elation that James has done quite well except for his “Quick Silver speculation.” With envelope addressed to 120 Park Street, Baltimore. Letter from E. Y. Buchanan to H. B. Swarr thanking him for his resumé of his latest correspondence with the Johnstons; saying that Mrs. Johnston has no power to prevent the removal of the papers from Wheatland and leaving the legal steps necessary to remove the papers to Swarr; denying that he and his daughter Annie left papers at Wheatland in confusion after sorting out important ones for Mr. Reed, although agreeing that they are now in confusion; noting the absurdity of Mrs. Johnston suggesting that increasing the biographical fund to $20,000 would in any way assure the rapid acquisition of a suitable biographer; and sympathizing with Mr. Swarr on having to correspond with such unreasonable persons as the Johnstons. Swarr gratefully acknowledging receipt of the semi-annual interest on his Russell mortgages; wishing to discuss Mr. Wiley’s mortgage; noting that Miss Hetty and Mrs. Dunham are visiting and that Miss Hetty has informed him that the Johnstons are planning a trip to Montreal; requesting information on what the Johnstons are planning to do about the law suit; and noting how unseemly it appeared for African-American men to be voting alongside white men at the polls in Frankford that morning. Swarr stating that he would certainly be present for giving depositions in connection with the exceptions to Mr. Swift’s report, were it not that his health requires him to avoid all excitement, but he will send relevant documents; denying that Mrs. Johnston offered to contribute double the sum that Rev. Edward Young Buchanan or James Buchanan Henry might contribute to the fund for the biography, but instead offered to unite with Rev. Buchanan or Mr. Henry in contributing equally the sum of $5000 each; and suggesting that the $5000 for the fund should properly remain in the estate, since it was mentioned in their second account which was duly confirmed. Swarr indicating he could not find the copy of the agreement sent to Mrs. Johnston which she returned unsigned; supposing that the Johnstons are the only ones required to make depositions on Saturday; reporting that Mr. Preston brought letters from Mr. Capen, G. S. Hillard, Judge Payne, and Colonel Greene supporting his bid to become James Buchanan’s biographer; noting that another possible candidate for biographer is H. B. Dawson, editor of the New York Historical Magazine, who has written several articles favorable to James Buchanan, and asking for news of what the Johnstons swear to at the deposition. 327, 329 &331 Chestnut St., Philadelphia.
